Do trademarks have to be registered?

No.  However, registration provides many benefits.  The primary benefits are to put others on notice that you claim the right to the mark across the United States, to allow the use of the ® symbol in association with the mark, and to provide assumptions as to the strength, validity, and ownership of the trademark in actions to enforce the mark against infringers.
