How is a trademark obtained?

Trademarks automatically vest in a business when it directs its goods / services into commerce and the mark acquires secondary meaning by becoming an identifier of that business as the source of those goods / services.  In other words, once the mark acquires goodwill and is associated with a business’s goods / services a common law trademark vests.
